These Terms and Conditions set out the basis on which Wibawa provides pension legal assistance services. Please read them carefully before engaging our services. By instructing us or using this website, you confirm that you have read and agree to be bound by these terms.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

  • "Agreement" means these Terms and Conditions together with any engagement letter or service confirmation issued by Wibawa.
  • "Service" means any pension legal assistance service provided by Wibawa, including but not limited to Pension Entitlement Review, Pension Adjustment and Recalculation Assistance, and Survivor and Dependant Pension Support.
  • "We", "Us", "Our" refers to Wibawa, a legal practice registered and operating in Malaysia, with offices at 88 Jalan Tun Razak, 50400 Kuala Lumpur.
  • "You", "User", "Client" refers to any individual or entity who accesses this website or engages Wibawa for legal services.
  • "Content" means any written summaries, legal advice, correspondence, reports, or other materials produced by Wibawa in connection with the Service.
  • "Website" means the Wibawa website accessible at https://wibawaq.club.

2. Acceptance of Terms

By accessing this website or by engaging our services, you confirm that:

  • you are at least 18 years of age, or are acting under the lawful authority of a person who is;
  • you have the legal capacity to enter into a binding agreement;
  • you have read and understood these Terms and Conditions in their entirety;
  • you agree to be bound by these Terms and Conditions from the date of your first engagement with us or use of this website, whichever is earlier.

If you are engaging our services on behalf of a third party — for example, as a dependant or representative of a pension claimant — you confirm that you have authority to accept these terms on their behalf and to instruct us accordingly.

3. Service Description

Wibawa provides specialist legal assistance in the area of Malaysian pension law. Our services are directed at individuals and families navigating pension entitlements, adjustments, and dependant claims under Malaysian retirement frameworks.

3.1 Available Services

  • Pension Entitlement Review (RM 1,650) — a measured initial review of pension entitlement, resulting in a written summary for the client's reference.
  • Pension Adjustment and Recalculation Assistance (RM 1,950) — assistance where a pension figure is believed to have been incorrectly calculated or not properly adjusted.
  • Survivor and Dependant Pension Support (RM 580) — considered guidance for spouses, children, and other dependants following the loss of a contributor.

3.2 Service Availability

Our services are available to persons with pension matters arising under Malaysian law. We do not advise on pension schemes governed by foreign jurisdictions. We reserve the right to decline an instruction where we determine a conflict of interest exists or where the matter falls outside our area of practice.

4. Your Responsibilities

When engaging our services, you agree to:

  • provide accurate, complete, and current information about your circumstances and any relevant documents;
  • inform us promptly of any change in your circumstances that may affect the matter;
  • respond to our requests for information or documentation within a reasonable time;
  • use this website and our services only for lawful purposes and in accordance with these terms;
  • not attempt to misrepresent your identity, status, or the nature of your pension matter.

4.1 Prohibited Activities

You agree not to use this website or our services to:

  • make false or misleading representations to us or to any relevant pension administrator;
  • seek advice for any purpose that would constitute a fraud on a pension scheme or administrator;
  • interfere with, disrupt, or attempt to gain unauthorised access to any part of our website or systems;
  • reproduce or transmit any Content produced by us without our prior written consent.

5. Intellectual Property

All Content, documents, written summaries, and materials produced by Wibawa in connection with the Service remain the intellectual property of Wibawa until fees for that work have been settled in full. Upon settlement of fees, you are granted a limited, non-exclusive, personal licence to use the Content for the purpose for which it was prepared.

You may not reproduce, distribute, or publish any Content produced by us for commercial purposes or for use in any matter other than the one for which it was prepared, without our prior written consent. The design, text, and structure of this website are owned by or licensed to Wibawa and may not be copied or reproduced without permission.

6. Payment Terms

Our service fees are quoted in Malaysian Ringgit (RM) and are set out in our service descriptions and any engagement letter. Fees are payable in advance of or concurrent with the commencement of work unless otherwise agreed in writing.

6.1 Accepted Payment Methods

We accept payment by bank transfer, online banking (FPX), and such other methods as we may advise from time to time.

6.2 Refund Policy

Where work has not yet commenced, fees paid in advance may be refunded upon written request. Once substantive work has begun, fees are generally not refundable, though we will consider requests on a case-by-case basis where exceptional circumstances apply. Any decision to refund in part or in whole rests with Wibawa and is made at our sole discretion.

6.3 Disbursements

Any out-of-pocket costs incurred on your behalf — such as administrative fees charged by pension bodies or courier costs — will be charged separately and itemised in our billing. We will inform you of likely disbursements before incurring them.

7. Service-Specific Terms

7.1 Scope and Changes

The scope of each service engagement is confirmed at the outset. If your circumstances change materially, or if additional work becomes necessary beyond the agreed scope, we will discuss this with you before proceeding and provide a revised fee estimate where applicable.

7.2 Confidentiality

We treat all information you share with us as confidential. We will not disclose your personal details or the particulars of your matter to any third party without your consent, except where required by law or where necessary to act on your instructions (for example, in corresponding with a pension administrator on your behalf).

7.3 Timelines

We will advise you of expected timelines at the outset and keep you informed of progress. We cannot control the response times of external bodies such as pension administrators, and delays attributable to third parties are not within our responsibility to manage.

7.4 Client Decisions

Our role is to advise and to act on your instructions. The decision to take any step in your matter — including whether to escalate, to correspond, or to accept a proposed resolution — remains yours. We will set out the options and our assessment of each, but we will not take any material step without your prior approval.

8. Disclaimers

The information on this website is provided for general reference only and does not constitute legal advice. Every pension matter turns on its particular facts; general information cannot substitute for a review of your specific circumstances.

We do not represent that any particular outcome is achievable in your matter. The engagement of our services does not carry any assurance of a specific result. Outcomes in pension matters depend on the applicable legislation, the records available, the conduct of administrators, and other factors outside our control.

This website and its contents are provided as they stand. We do not represent that the website will be free from error or continuously available.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Wibawa's liability to you in connection with any Service or in respect of any claim arising from these Terms shall be limited to the fees paid by you for the Service to which the claim relates.

We shall not be liable for any loss of income, loss of data, indirect loss, or consequential loss arising from your use of this website or from any Service provided by us, except where such loss arises from our fraud or wilful misconduct.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be limited by law.

10. Indemnification

You agree to indemnify and hold Wibawa harmless from any claim, cost, or expense (including reasonable legal costs) arising from your breach of these Terms, your provision of inaccurate information to us, or your misuse of our services or this website. This indemnity applies to the extent that the loss or claim arises from your conduct and not from any act or omission on our part.

11. Termination

Either party may bring the engagement to an end at any time by giving written notice. You may withdraw your instruction at any point; we will promptly confirm receipt and advise on any outstanding fees for work done to that point. We may cease to act for you if a conflict of interest arises, if you are in material breach of these Terms, or if continuing to act would be professionally improper.

On termination, provisions relating to confidentiality, intellectual property, payment for work done, limitation of liability, and dispute resolution shall continue to apply.

12. Dispute Resolution

These Terms and any dispute arising from them are governed by the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction over any dispute that cannot be resolved informally.

12.1 Informal Resolution

If you have a concern about our services, we ask that you first raise it with us directly by writing to [email protected]. We will acknowledge your concern within five business days and endeavour to respond substantively within 14 days. Most concerns can be resolved at this stage and we prefer this route over formal proceedings.

12.2 Formal Proceedings

Where informal resolution is not achieved, either party may refer the matter to the Malaysian Bar's complaints process (where applicable) or to the courts of Malaysia. We are also open to mediation as an alternative to litigation where both parties agree.

13. General Provisions

  • Entire Agreement: These Terms, together with any engagement letter, represent the entire agreement between us with respect to the subject matter and supersede any prior discussions or representations.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Our failure to enforce any right under these Terms on any occasion does not constitute a waiver of that right on any future occasion.
  • Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may transfer our obligations to a suitably qualified successor practice, in which case we will inform you in advance.
  • Notice: Notices under these Terms shall be given by email or by post to the addresses set out in our engagement letter or on this website.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in law, our practices, or the services we offer. Any material changes will be posted on this website and the "Last Updated" date at the top of this document will be revised accordingly. Continued use of our services following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree with any revision, please inform us promptly in writing.
